VBB’s EU and UK merger control experts author key chapters in Chambers global guide

The Chambers Merger Control 2023 Guide (Guide) is available now. The Guide provides a clear and user-friendly overview of the key aspects of merger control rules, and their application in practice, in 41 jurisdictions around the world. VBB is pleased to have authored the EU and UK chapters, and to be the Guide’s global contributing editor.

Drawing on first-hand experience in guiding clients’ high-profile transactions through merger control and other regulatory processes, VBB competition co-head Porter Elliott and counsel Catherine Gordley wrote the EU chapter, while London competition head Alex Stratakis, head of strategy and associate Reign Lee, and senior associates Marc Freedman and Todor Papanov, with assistance from associate Sophie Sundaram, contributed the UK chapter. VBB founding partner Jean-François Bellis and Porter Elliott were global co-editors of the Guide and authored the Guide’s scene-setting introductory chapter.

Among the issues covered by the Guide are notification requirements; tests for substantive review; procedural requirements and timing; remedies; penalties; appeals and judicial review; authorities’ current areas of focus and key trends. For the first time, considerations relevant to foreign direct investment/national security regulation and foreign subsidy review are included. A clear takeaway for merging parties is that global M&A continues to face increasingly aggressive regulatory scrutiny and that early deal planning and careful coordination remain crucial in order to minimise execution risk.
