VBB assists Switzerland in its successful WTO challenge of the US Section 232 measures on steel and aluminium

On 9 December, the Panel released its final report in the WTO dispute settlement proceedings in which Switzerland challenged the measures imposed since 2018 by the US on steel and aluminium. These measures restricting imports were imposed by the Trump administration allegedly for reasons of national security.

In its report, the panel concludes that the US measures are contrary to several provisions of the General Agreement on Trade in Goods (GATT), and that they are not justified by the security exception contained in Article XXI of the GATT 1994.

Switzerland was assisted by Clotilde du Parc, Joanna Redelbach and Tetyana Payosova.

The US has already announced that it will not comply with the Panel’s findings and will maintain the measures.
