Court of Justice of European Union Clarifies Rules on Distance Selling of Medicinal Products Not Subject to Medical Prescription

On 29 February 2024, the Court of Justice of the European Union delivered a judgment in response to a reference for a preliminary ruling from the Paris Court of Appeal concerning the online sale and supply to the general public of medicinal products not subject to medical prescription. The judgment clarifies that companies which are not authorised to sell over-the-counter medicinal products to the general public are free to connect customers with pharmacies a long as these companies do not sell the medicines themselves.
