We are pleased to announce that Van Bael & Bellis has authored the Belgian chapter of Lexology In-Depth: Class Actions, a comprehensive guide offering legal practitioners and clients a global overview of class and collective action regimes.

With an average of one class action per year since its introduction over a decade ago, the class action mechanism has not yet achieved significant popularity in Belgium. The recent transposition of the EU Representative Actions Directive introduced several changes in the Belgian legal framework but it remains to be seen whether these changes will result in more collective actions being initiated before the Belgian courts.

Drawing from our first-hand expertise, our chapter offers a detailed analysis of the evolving class action landscape in Belgium, including:

  • Conditions for bringing class actions
  • Opt-in vs opt-out system
  • Cost, funding and settlement considerations
  • The challenge of data protection-related claims in Belgium
  • The growing relevance of cross-border claims

The chapter is authored by Catherine Longeval, Thibaut D’Hulst and Malik Aouadi.
