Fundamental Rights Impact Assessment under EU AI Act

On 13 March 2024, the European Parliament adopted the European Union Artificial Intelligence Act (AI Act), one of the first and possibly the most comprehensive regulation of AI in the world.
 
In this client alert, we take a first look at a new type of impact assessment introduced by the AI Act: the Fundamental Rights Impact Assessment (FRIA). We explain that the scope of this new obligation may be broader than it appears to be at first sight and discuss when organisations should consider a FRIA, and how to combine it with similar requirements, such as a Data Protection Impact Assessment that will still be required for many high-risk AI systems.
