VBB competition experts author EU cartel chapter in global Chambers guide

Cartel enforcement continues to top the European Commission (Commission)’s priority list. In spite of an inevitable lull in dawn raid activity during the Covid-19 epidemic, the Commission has remained fully committed to tackling cartels and unannounced inspections are now very much back in force. Recent raids have involved companies active in sectors including automotive, defence, grocery retail,  garment manufacture and fashion. Not only is raid activity unlikely to abate any time soon but the Commission is also adopting a more forensic, data-focused approach and investigating behaviour beyond the “classic” types of cartel activity, with a resulting increase in compliance challenges for companies.  

Against this backdrop, partner Andrzej Kmiecik, senior counsel Richard Burton and counsel Catherine Gordley from our competition team have co-authored the EU chapter of Chambers Global Practice Guides – Cartels 2023. Drawing on the team’s longstanding experience handling cartel defence cases, the chapter gives a practical overview of the relevant legislation and procedural framework applicable to cartel-related activity at EU level, covering issues such as dawn raids, immunity/leniency, privilege, sanctions and private damages actions. The EU is one of 21 jurisdictions featured in this year’s guide.
