Van Bael & Bellis successfully assists Argentinean biodiesel producers in obtaining the annulment of EU anti-dumping duties on imports of biodiesel from Argentina

The EU General Court has upheld the appeal brought by Van Bael & Bellis on behalf of Argentinean producers of biodiesel and annulled Council Implementing Regulation (EU) No. 1194/2013 imposing definitive anti-dumping duties and collecting definitively provisional anti-dumping duties on imports of biodiesel from Argentina insofar as it affected the companies represented by the firm.
The case stems from anti-dumping and anti-subsidy investigations initiated by the Commission in 2012. The anti-subsidy investigation was terminated without measures but anti-dumping duties were imposed. These duties were challenged before the EU General Court and the WTO. On 29 March 2016, the WTO circulated the findings of the WTO Panel in this dispute upholding Argentina’s challenges to certain aspects of the anti-dumping measures imposed by the EU on imports of biodiesel from Argentina. On 15 September 2016, the EU General Court annulled the anti-dumping duties.
